Legal Position

Abandoning a vehicle on land in the open air or on a highway is a criminal offence under Section 2 of the Refuse Disposal (Amenity) Act 1978.

In addition, where a vehicle has reached the end of its useful life, it may constitute controlled or hazardous waste under the Environmental Protection Act 1990. Unlawful deposit or disposal can therefore amount to a further offence.

Where vehicles are left on private land without consent, action may be taken under the Torts (Interference with Goods) Act 1977. This legislation permits a landowner, or their appointed enforcement agent, to serve formal notice requiring the vehicle owner to remove it within a specified period. If the vehicle is not removed within that timeframe, lawful steps may be taken to remove and, where appropriate, dispose of the vehicle.

All notices issued by Court Enforcement Specialists are compliant with the relevant statutory requirements.

A “vehicle” includes:

  • Motor vehicles
  • Caravans and trailers
  • Parts of motor vehicles or trailers
  • Items contained within such vehicles

While local authorities have statutory powers to remove abandoned vehicles, private landowners are also entitled to take lawful steps to remove vehicles from their land, provided the correct procedure is followed.

What Is an Abandoned Vehicle?

There is no single fixed definition. Indicators commonly include:

  • No valid tax or MOT
  • Significant damage or missing parts
  • Flat tyres or immobilisation
  • Long-term stationary presence
  • Evidence of vandalism
  • Reports from residents or tenants

Each case is assessed on its individual circumstances before action is taken.

Where removal is required, vehicles are transported to an Authorised Treatment Facility (ATF). Hazardous materials are safely removed before recycling. Upon completion, a DVLA Certificate of Destruction (CoD) is issued where applicable.

For vehicles that cannot be easily lifted or moved, we utilise specialist recovery equipment to ensure safe and effective removal.

All removals are conducted legally, professionally and in accordance with environmental regulations.

Our Costs

  • £450.00 plus VAT – Service of legal notice
  • £270.00 plus VAT – Agent attendance (first hour) to oversee removal
  • £90.00 plus VAT – Per hour thereafter

Recovery, storage, and treatment facility costs will be charged at actual cost. Where substantial costs are anticipated, client authority will be obtained prior to proceeding.
