The current pandemic has affected absolutely everyone in a number of different ways, and unfortunately for landowners, they are no more immune than the trespassers they sometimes play cat and mouse with.

The urgency with which all manner of COVID-19 legislation was passed meant that problems were always likely to occur with the implementation of any temporary ‘rules’ of the game, and this was certainly found to be the case for landowners unfortunate enough to have trespassers on their site as the country went into #lockdown.

As eviction proceedings were suspended, landowners found their hands tied, and trespassers looked to have gotten a bit of a ‘get out of jail free’ card.

Well, in a move that will surely please landowners up and down the country, all that has just changed, the Practice Direction 51Z issued on 27th March 2020, the 120th practice direction update allows possession proceedings against persons unknown.

The Practice Direction which stayed all possession proceedings has been amended to allow proceedings against persons unknown. In addition to this, interim possession orders and claims for injunctive relief are also now back on the cards.

The protection against eviction was never meant to be there for those who squat or trespass illegally, and we are pleased to now be able to support landowners with the repossession and clearance of their premises.
