The #TeamCES Approach Traveller Eviction

Landowners and local authorities have two main routes to go down when they need to regain possession of their land and evict travellers.


Option 1 – Common Law

Landowners are permitted to use reasonable force (if required) to remove trespassers from their land. Enforcement Agents carry out the evictions, usually under observation from the police.

The benefits of using Common Law are as follows:

· Speedy solution (eviction within 24 hours)

· Less time for fly tipping

· No need to go through the court


Option 2 – Writ of Possession

Firstly, the landowner must obtain a writ of possession, making it out against ‘persons unknown’. Once this awarded, the claimant then transfers it up to the High Court, to be enforced by a High Court Enforcement Officer (HCEO).

The benefits of using a Writ of Possession are as follows:

· Notice does not need to be given

· Element of surprise is an advantage


Landowners are able to follow both routes at the same time, should they wish to, and many find that Common Law achieves a successful resolution very quickly.
